Use of iRadTech Mobile Web constitutes acceptance of our Terms of Use and Privacy Policy.

Overview:
iRadTech Mobile Web is an online subscription service, providing subscribers with access to radiographic positioning data, images, and suggestions over the Internet to certain Internet-connected computers, phones, tablets and other devices via their browser (“web-ready devices”). Users should read and understand the terms and conditions outlined below as they govern the use of the iRadTech Mobile Web product.
These Terms of Use provide that all disputes between you and iRadTech Mobile Web will be resolved by BINDING ARBITRATION. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract (except for matters that may be taken to small claims court). Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury and your claims cannot be brought as a class action. Please review the Arbitration Agreement below for the details regarding your agreement to arbitrate any disputes with the owners of the iRadTech Mobile Web product.
The following Terms of Use describe how this service works, including collection of data, billing and communication with our company, etc. We hope you enjoy your iRadTech Mobile Web experience.
Acceptance of Terms of Use
These Terms of Use, which include our Privacy Policy and End User License Agreement (“EULA”) govern your use of the iRadTech Mobile Web service, including all features and functionalities, website and user interfaces, and all content and software associated therewith (the ” iRadTech Mobile Web service” or “service”). By using, visiting, or browsing the iRadTech Mobile Web service, you accept and agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you should not use the iRadTech Mobile Website service, including our website, iRadTech.com, and user interfaces.
These Terms of Use govern your use of iRadTech Mobile Web service and you should read them carefully. The iRadTech Mobile Web service is provided by Ballinger and Bruckner, LLP dba RadTech Resource Group.
Changes to Terms of Use
iRadTech Mobile Web reserves the right, from time to time, with or without notice to you, to change these Terms of Use, including the Privacy Policy and EULA, in our sole and absolute discretion. The most current version of these Terms of Use can be reviewed by visiting our website and clicking on “Terms of Use” located at the bottom of the pages of iRadTech Mobile Web and iRadTech.com. The most current version of the Terms of Use will supersede all previous versions.
Subscription and Billing
Billing
By subscribing to the iRadTech Mobile Web product, the user expressly agrees that Ballinger and Bruckner, LLP, dba RadTech Resource Group is authorized to charge an annual subscription fee and any other charges the user may incur in connection with the use of the iRadTech Mobile Web service at the then current rate via PayPal (Payment Method). Although highly unlikely, prices and charges are subject to change without notice. As used in these Terms of Use, “billing” shall indicate either a charge or debit, as applicable, against the user’s Payment Method. The subscription fee will be billed at the beginning of the paying portion of the subscription and each year thereafter unless and until the user cancels his/her subscription. Membership charges are fully earned upon payment.
Cancellation
Users may cancel iRadTech Mobile Web subscriptions at any time. BALLINGER AND BRUCKNER, LLP DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-YEAR SUBSCRIPTION PERIODS. To cancel, the user must log in to his/her PayPal account, select the “Settings” icon next to “Log out”, select the “Payments” tab, select “Automatic payments” and then select “Manage automatic payments”. Select the payment to be canceled and then click/tap “Cancel”. User’s account will remain active until the current subscription period expires.
Right to Terminate
Ballinger and Bruckner, LLP reserves the right to terminate or restrict use of the iRadTech Mobile Web service, without notice, for any or no reason whatsoever.
Account Access; Identity Protection
In order to provide ease of access to a user’s account and to help administer the iRadTech Mobile Web service, iRadTech Mobile Web implements technology (cookies) that enables us to recognize the account holder and provide the user with direct access to his/her account without requiring user to retype any password or other user identification when revisiting the iRadTech Mobile Web service. User is responsible for updating and maintaining the truth and accuracy of the information provided to Ballinger and Bruckner, LLP relating to his/her account.
User is also responsible for maintaining the confidentiality of his/her account and password and for restricting access to the iRadTech Mobile Web-ready device. If user discloses password or shares account information and/or devices with other people, user takes full responsibility for their actions. Where possible, users of public or shared devices should log out at the completion of each visit. If user fails to log out or deactivate device after using iRadTech Mobile Web, others may be able to access certain of user’s personal account information.
Ballinger and Bruckner, LLP reserves the right to place any account on hold anytime with or without notification to the subscriber in order to protect its partners from what it believes to be fraudulent activity. Ballinger and Bruckner, LLP is not obligated to credit or discount a subscriber for holds placed on the account by either a representative of Ballinger and Bruckner, LLP or by the automated processes of iRadTech Mobile Web.
Disclaimers of Warranties and Limitations on Liability
As a user of iRadTech Mobile Web,
• I acknowledge that I have read and agreed to the following waiver, and I signify that I understand all of the following contained in this full disclaimer statement: I understand that to the fullest extent allowed by law, the authors, owners, service providers and any of their agents (“Provider”) are not responsible for any injury and/or damage to persons or property arising from any use of this product or the material communicated therein (this/the Product). Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
• I accept responsibility for my use of this Product and will not misuse the Product.
• I understand that only registered/licensed practitioners who are graduates of a medical, chiropractic or radiography program and students supervised by such a practitioner should use this Product.
• I understand that knowledge, best practices, and standards in this field are constantly changing and there is no guarantee that the practices presented in any part of this Product are the most current or best method for any individual examination.
• I understand that it is the responsibility of the practitioner, relying on his or her own experience and knowledge of the specific patient, to perform a proper examination for each patient, and to take all safety precautions to comply with the proper standard of care.
• I am aware that as new research, experience and technology expand our knowledge and capabilities, changes in practice, treatment and/or methodology may become necessary or appropriate.
• I should continually monitor and utilize technology updates or content updates for this Product.
• I understand that every technology can and does have periodic failures and release Provider from liability or damage for any such reasonable failure.
All terms, terminology and language used in this Product are based upon the common language used in the relevant community in the United States and any derivations of English or translations into other languages, or dialects are expressly prohibited without express written consent of the authors and owners and the Provider waives any liability for any such translation or language differences among users of this Product. This product and all associated services are sold “as is” and “with all faults”. The entire risk as to the quality and performance of the product is with the buyer; and if the product proves defective after purchase, the buyer and not the manufacturer, distributor or retailer assumes the entire cost of all necessary servicing or repair, unless your seller provided their own express written mechanical warranty. I understand that there are no warranties which extend beyond the description on the face hereof.
Limitations on Use
The iRadTech Mobile Web service, and any content viewed through our service, is for personal and non-commercial use only and Ballinger and Bruckner, LLP grants the user a limited, non-exclusive, non-transferable, license to access the iRadTech Mobile Web service for that purpose. Except for the foregoing limited license, no right, title or interest shall be transferred to the user. User may not download (other than through page caching necessary for personal use, or as otherwise expressly permitted by these Terms of Use), modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained on, or obtained from or through, the iRadTech Mobile Web service, without the express written consent of Ballinger and Bruckner, LLP. Provider does not promote, foster or condone the copying of content, digitally delivered content, or any other infringing activity. User may not circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the iRadTech Mobile Web service. User may not frame or utilize any framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of iRadTech Mobile Web without the express written consent of Ballinger and Bruckner, LLP. User may not purchase search terms or use any meta tags or any other “hidden text” utilizing the iRadTech Mobile Web name or trademarks without the express written consent of Ballinger and Bruckner, LLP. Any unauthorized use of the iRadTech Mobile Web service or its contents will terminate the limited license granted by Ballinger and Bruckner, LLP and will result in the cancellation of user’s subscription.
Arbitration Agreement
User and Ballinger and Bruckner, LLP agree that any dispute, claim or controversy arising out of or relating in any way to the iRadTech Mobile Web service, including the associated website, user interfaces, these Terms of Use and this Arbitration Agreement, shall be determined by binding arbitration. The user agrees that, by accepting these Terms of Use, the U.S. Federal Arbitration Act governs the interpretation and enforcement of this provision, and that the user and Ballinger and Bruckner, LLP are each waiving the right to a trial by jury or to participate in a class action. This arbitration provision shall survive termination of this Agreement and the termination of the user’s iRadTech Mobile Web subscription.
If the user elects to seek arbitration, please send an email to info@iRadTech.com for further information. If Ballinger and Bruckner, LLP elect to seek arbitration, written notification will be sent to the email address used for the user’s subscription account. Notification, whether sent by the user or by Ballinger and Bruckner, LLP, must (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought (“Demand”). If user and Ballinger and Bruckner, LLP do not reach an agreement to resolve the claim within 30 days after the notification is received, notifying party may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by Ballinger and Bruckner, LLP or the user shall not be disclosed to the arbitrator. User may download or copy a form Notice and a form to initiate arbitration at www.adr.org.
Privacy Policy
Any personally identifying information submitted through the iRadTech Mobile Web service is subject to this Privacy Policy, the terms of which are incorporated herein. Please review this Privacy Policy to understand Ballinger and Bruckner, LLP practices.
By using the iRadTech Mobile Web service, user consents to receiving electronic communications from Ballinger and Bruckner, LLP. These communications may/will include notices about the user account (e.g., change in password or Payment Method, confirmation e-mails and other transactional information) and information concerning or related to our service. These communications are part of the user’s relationship with Ballinger and Bruckner, LLP and users receive them as part of the iRadTech Mobile Web subscription. The user agrees that any notice, agreements, disclosure or other communications that Ballinger and Bruckner, LLP send to the user electronically will satisfy any legal communication requirements, including that such communications be in writing.
Ballinger and Bruckner, LLP are the sole owners of the information collected on this site. This company only has access to and/or collects information that the user voluntarily provides via email or other direct contact. Ballinger and Bruckner, LLP will not sell or rent this information to anyone and will use information provided only to manage your subscription to iRadTech Mobile Web. Ballinger and Bruckner, LLP will not share user information with any third party outside of our organization, other than as necessary to fulfill user’s request, e.g., with PayPal, to process payment and subscription.
Ballinger and Bruckner, LLP takes precautions to protect the user’s information. When submitting sensitive information via the website, information is protected both online and offline. Whenever information is exchanged with users, that information is encrypted and transmitted in a secure way. Users can verify this by looking for a lock icon in the address bar and looking for “https” at the beginning of the address of the Web page. The computers/servers in which Ballinger and Bruckner, LLP store personally identifiable information are kept in a secure environment for offline protection.
